This Privacy Policy (“Policy”) describes the personal information collected by or on behalf of Forus, Inc. (“Forus,” “we,” “us,” or “our”) in connection with your use of our provider portal (“Portal”), as well as how that information is used and disclosed. By accessing or using the Portal, you acknowledge the data practices contained in this Policy. Access and use of withtandem.com (“Site”) and the other portals available via the Site are subject to separate privacy policies. The terms of those policies do not apply to this Portal. If you have questions or concerns about this Policy, please contact us as set forth below.
This Policy only applies to individuals acting in the capacity of healthcare providers or as representatives of healthcare providers in connection with Forus’s services, including prescribers and prescriber delegates. For clarity, this Policy does not apply to users of the patient or manufacturer portals. If you are a patient, please see our Patient Privacy Policy for information that applies to you.
We may modify this Policy at any time. Material changes will be conspicuously posted on the Portal or otherwise communicated to you. All changes will be effective immediately upon posting to the Portal.
Please note that this Policy does not apply to any information that is collected or processed through the Portal that constitutes protected health information (“PHI”) as defined by the Health Insurance Portability and Accountability Act, as amended, and its regulations (“HIPAA”). PHI submitted by a healthcare provider may be subject to a Business Associate Agreement between Forus and the provider, as applicable.
1. Information We Collect
We may collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly with you (“Personal Information”) in the context of your business relationship with us. The Personal Information we collect falls into three categories: (1) information you provide to us, (2) information we collect through automated methods, and (3) information we collect from other sources, each further detailed below. We will collect, use, and disclose such Personal Information pursuant to this Policy and applicable law.
Information You Provide to Us
We collect Personal Information that you provide directly to us. This may occur in the following ways:
Account Creation: Subject to the Terms of Service for Forus Provider Services, providers must submit certain Personal Information in order to create an account, including but not limited to name, email address, phone number, and certain professional information, such as your National Provider Identifier (NPI) number, your role and title, credentials, licenses and license numbers.
Feedback: When you provide comments or feedback about the Portal, the content on the Portal, or our services, including suggestions, survey responses, and complaints (“Feedback”), we will collect Personal Information that you submit along with your Feedback. However, we will not treat that Feedback as confidential, and we may use that Feedback for any purpose in our sole discretion so long as it does not personally identify you. Feedback may be used without attribution or compensation to you.
Contacting Us: When you contact us, either via the Portal or other methods, we will collect your Personal Information that you choose to provide.
Data Automatically Collected
We may use automated technologies to collect Personal Information from your computer system or mobile device when you use the Portal. This may include the following:
Cookies & Other Tracking Technologies. We may use cookies, web beacons, pixel tags and other tracking technologies (collectively “Tracking Technologies”) on the Portal. Most browsers automatically accept Tracking Technologies. You may be able to disable Tracking Technologies by changing your browser settings, depending on your browser, but disabling Tracking Technologies may impact your use and enjoyment of the Portal. Not all features or functions of the Portal may work properly if you disable Tracking Technologies. You cannot disable all Tracking Technologies, such as those that are essential to the functioning of the Portal.
The Tracking Technologies on the Portal may collect information such as:
- IP addresses assigned to the computers and other devices you use;
- device type and operating system;
- approximate geographic location;
- browser type;
- the URL of a referring link before accessing the Portal,
- Portal pages visited; and
- data related to how and when you use the Portal.
How We Use Your Information
We use Personal Information that we collect for the following purposes:
To Provide Services: We use Personal Information for enabling the provision of our services to you and other users of our services, including patients and manufacturers, via our Portal as well as through other channels.
As Stated or Agreed to at the Point of Collection. We use Personal Information for the purposes stated or agreed-to (or as is obvious) at the point of collection. For example, we use Personal Information to respond to your questions or comments. We may also use Personal Information as otherwise requested or consented to by you.
Administration. We use Personal Information for administrative purposes, such as to inform our business strategies, and to understand the Portal’s demographics and user preferences.
Portal Management. We use Personal Information for management of the Portal, such as troubleshooting problems, improving the content and functionality, statistical and other analyses of the Portal, and to customize the Portal to you and our users.
Business Analytics. We use Personal Information for business analytics purposes, including consumer and operations research, development of new products and services, to assess the effectiveness of the Portal, and online services.
Other Communications; Marketing and Advertising. We may use Personal Information to send you advertisements, notify you of new features on the Portal or to our services, to notify you of changes to our terms or this Policy, and for other similar communications, including via email and fax. We may use third-parties or service providers to deliver communications to you. You may opt-out of marketing emails by using the unsubscribe link in the email. Opting out of marketing communications does not opt you out of non-marketing communications.
To Protect Our Rights. We may use Personal Information to protect our legal rights or interests, or those of other parties, including to bring a legal action against you or anyone who may be causing harm to us, the Portal, or to other users of the Portal. We may also use Personal Information to seek business, financial or legal advice, and to respond to other legal requests.
Create Aggregated and De-Identified Data. We may process Personal Information to create deidentified and aggregated data. Any such deidentified and aggregated data is no longer subject to this Privacy Policy. We are the sole and exclusive owner of such de-identified and anonymized information.
How We Use Data Collected by Tracking Technologies.
We use Tracking Technologies to: (i) make the Portal function properly; (ii) provide personalized experiences, including remembering your preferences; (iii) tailor our interactions with you; (iv) help with our marketing efforts; (v) provide us with valuable data and statistics about the usage and effectiveness of the Portal and to help us improve the Portal; (vi) help us improve our services; and (vii) for troubleshooting purposes, including for replay sessions.
- Analytics. We use analytics tools to collect and process information about your use of the Portal. Our vendors may set Tracking Technologies on your browser or device, and then your web browser will automatically send information to our vendors who use this information to provide us with reports that we use to better understand and measure how users interact with the Portal.
3. Retention of Personal Information
We will keep Personal Information for the period necessary to fulfill the purposes described in this Policy, unless a longer retention period is permitted or required by law.
4. Disclosure of Personal Information
We may disclose Personal Information to the following categories of third parties:
Affiliates. We may disclose Personal Information to our affiliates who have a need to know the information for our business purposes.
Patients, Manufacturers, and Other Users of our Services. We may disclose Personal Information, including your name, contact information, license information, NPI number and TIN, to patients, manufacturers, and other users of our services in the course of providing our services.
Third Parties and/or Service Providers. We may disclose Personal Information to third parties and/or service providers that provide services for us. For example, we may disclose Personal Information to vendors to help us host and manage the Portal, provide advertising and marketing, improve the content and functionality of the Portal, perform data and statistical analyses, troubleshoot problems with the Portal, and support or provide the security of the Portal.
Government Officials / Law Enforcement. We will cooperate with law enforcement and other governmental agencies, and may disclose Personal Information: (i) if we believe in good faith we are legally required to disclose that Personal Information, (ii) if we are advised to disclose Personal Information by our legal counsel, (iii) when necessary to identify, contact or bring a legal action against someone who may cause or be causing harm to, or interfering with the legal rights of, Forus or any other party, (iv) or as otherwise appropriate.
Professional Advisors. We may disclose Personal Information to our professional advisors, such as our attorneys, accountants, financial advisors and business advisors, in their capacity as advisors to Forus.
Change in Ownership. In the event Forus is the subject of a change of control or in the event Forus or the Portal changes ownership, in whole or in part, or in the event of a bankruptcy, receivership or a similar transaction, we may disclose Personal Information to the subsequent owner(s) of the relevant business asset.
Other. We may disclose Personal Information to third parties when explicitly requested by or consented to by you, or for the purposes for which you disclosed the Personal Information to us as indicated at the time and point of the disclosure (or as was obvious at the time and point of disclosure).
5. Data Security
We use commercially reasonable technical and organizational measures to help secure Personal Information against loss, misuse, and alteration appropriate to the type of Personal Information processed. You understand that no data transmission over the internet can be guaranteed to be 100% secure. While we strive to protect Personal Information, we do not guarantee the security of Personal Information and you provide Personal Information at your own risk.
6. Third-Party Websites
The Portal may link to, or be linked from, websites not controlled by us. We are not responsible for third parties’ privacy policies or practices. This Policy does not apply to any third-party websites or to any data that you provide to third parties. You should read the privacy policy for each website that you visit.
